新的商標申請案 是否暗示了三星手機未來的名字?

品牌的命名以及將其註冊成商標,是每個品牌規劃上一個重要環節,因為品牌名稱對消費者而言,不論視覺上還是聽覺上,皆為第一線的衝擊。不過,在品牌命名的同時,尚須將商標法的限制考慮其中,因為商標的主要功能是辨別商品及服務來源,因此商標名稱必須具有識別性,然而,如何辨別商標名稱具有識別性?建議申請人可以掌握以下兩個方向:第一,商標名稱不能說明該商品/服務的「用途、品質、原料、材質、產地或其相關特性」,例如「有機」字樣不能指定於餐飲服務;第二,商標名稱不能為該商品/服務之「通用名稱」,例如「避風塘」字樣不能指定於餐飲服務。

Naming brands and trademarking them is an important step for the brand’s planning layout. The reason is the name of brand is a forefront impact for consumer on the both side of visuality and aurality. However, we shall need to take the registration of Trademark Law into consideration while we design the name of brand, because the main function of trademark is to distinguish where the Goods and Service are made, so trademark must have its distinctiveness. But, how to tell our brand’s name is distinguishable or not? Just to grasp some principles, first of all, trademark cannot describe the goods/service’s “purpose, quality, raw materials, material quality or other related characteristics,” such as, “Organic” cannot be used for the restaurant service; the second, trademark cannot describe the goods/service’s “general phrases”, such as, “Typhoon Shelter” cannot be used for the restaurant service.
